Article 1 — Definitions

In these terms, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal.

Consumer: the natural person not acting in a professional or business capacity who enters into a distance contract with the trader.

Day: calendar day.

Right of withdrawal: the consumer’s right to withdraw from the distance
contract within the cooling-off period.

Trader: Maison DION, established in the Netherlands.

General Terms and Conditions: these General Terms and Conditions of Maison DION.

Article 3 — Applicability

These terms and conditions apply to all offers, orders and agreements
via www.maison-dion.com. By placing an order, the consumer
unconditionally accepts these terms.

Maison DION reserves the right to amend these terms at any time. Amended terms apply from the moment of publication on the website.

If one or more provisions are void or nullified, the remaining provisions remain in full force. Maison DION will determine a replacement arrangement in such cases.

Article 4 — Offers and prices

All offers are non-binding. Maison DION reserves the right to modify, withdraw or refuse offers at any time without giving a reason.

Prices include VAT and exclude shipping costs. Maison DION reserves the right to change prices at any time.

Obvious printing or typographical errors in pricing do not bind Maison DION. Maison DION is not obliged to deliver a product at a demonstrably incorrect price.

Images on the website are indicative. Colour deviations on screen compared to the actual product do not entitle the consumer to a refund or cancellation.

Article 5 — Formation of agreement

An agreement is formed exclusively at the moment Maison DION has sent an order confirmation by email. A placed order without confirmation does not bind Maison DION.

Maison DION reserves the right to refuse an order without giving a reason or to attach additional conditions, including in cases of doubt regarding the consumer’s ability to pay or suspicion of misuse.

Maison DION is entitled to dissolve the agreement if the ordered products are no longer available, without the consumer being entitled to compensation.

Article 6 — Delivery

All delivery times are indicative. Exceeding a delivery time does not entitle the consumer to compensation or cancellation, unless delivery fails after a reasonable additional period.

Maison DION delivers within 30 days at the latest. If this is demonstrably not possible due to circumstances beyond Maison DION’s control, the consumer will be informed. Maison DION is not liable for any consequential damage in cases of force majeure.

The risk of damage or loss of products transfers to the consumer upon delivery to the stated delivery address.

Belgium — €8,85 | free from €130,-
Europe — €11,95

Article 7 — Right of withdrawal

The consumer has the right to withdraw from a purchase within 14 days of receipt. For SALE items, a period of 7 days applies. After this period, the right of withdrawal lapses.

The right of withdrawal applies exclusively to products returned unworn, undamaged, unwashed and with all original labels and packaging intact. Products not meeting these conditions will not be accepted and will not be refunded.

Returns must be registered via our returns portal before being sent. Unregistered returns will be refused.

The consumer must prove that the product was returned in time by means of proof of postage. In the absence of such proof, the right to a refund lapses.

Returns are sent at the consumer’s own risk.

Article 8 — Exclusion of right of withdrawal

The right of withdrawal is excluded for:

Products that are clearly personal in nature or made to measure.

Products whose hygiene seal has been broken.

SALE items after the reduced return period of 7 days has expired.

Products that have visibly been worn, damaged, washed or otherwise
used.

Article 9 — Costs upon withdrawal

All return shipping costs are at the consumer’s expense.

If free shipping was applied and the full order is returned, the original shipping costs (NL: €6,95 | BE: €8,85) will be deducted from the refund.

If the product has been damaged, shows wear or has decreased in value due to the consumer’s actions, Maison DION is entitled to deduct the reduction in value from the refund, up to the full purchase price.

Refunds are issued within 14 working days of receipt and approval of the return, via the original payment method. Maison DION is not obliged to refund earlier.

Article 10 — Payment

Payment must be made immediately upon placing the order via the available payment methods.

In the event of non-payment or late payment, Maison DION reserves the right to cancel the order, suspend delivery and charge collection costs.

The consumer is obliged to immediately report any inaccuracies in payment details. Maison DION is not liable for damages resulting from incorrect payment details provided by the consumer.

Article 11 — Liability

Maison DION is not liable for indirect damage, consequential damage, loss of profit or damage from loss of data, unless caused by intent or gross negligence.

Maison DION’s liability is in all cases limited to the amount paid by the consumer for the product in question.

Maison DION is not liable for damage resulting from incorrect use of products or use contrary to product information.

Article 12 — Conformity and complaints

Complaints regarding defects must be reported in writing within 14 days of discovery via info@maison-dion.com, with a clear description and photographic evidence. Complaints submitted after this period will not be processed.

Maison DION responds to complaints within 14 days. If further investigation is required, the consumer will receive an acknowledgement within 14 days.

In the event of a valid complaint, Maison DION chooses at its own discretion between repair, replacement or refund. The consumer has no right to additional compensation.

Disputes that cannot be resolved by mutual agreement may be submitted via the European ODR platform: http://ec.europa.eu/odr

Article 13 — Intellectual property

All rights to content on www.maison-dion.com — including texts, images, logos, designs and collections — belong exclusively to Maison DION. Use without prior written permission is not permitted and may result in legal action.

Article 14 — Privacy

Maison DION processes personal data in accordance with the GDPR. Data is used solely for the fulfilment of orders and, where consent has been given, for marketing purposes. Data is not shared with third parties unless required by law.

Article 15 — Applicable law and disputes

All agreements are governed exclusively by Dutch law, even if the consumer resides abroad. The Vienna Sales Convention does not apply.

All disputes are submitted exclusively to the competent court in the Netherlands.

Maison DION reserves the right to take legal action in the event of a breach of these terms.
